END USER LICENSE AGREEMENT (EULA) BambooBasic Version 1.0 Copyright (c) 2025 Michael Denathorn. All rights reserved. PLEASE READ THIS LICENSE AGREEMENT CAREFULLY BEFORE USING THIS SOFTWARE. By installing, copying, or otherwise using BambooBasic, you agree to be bound by the terms of this End User License Agreement ("EULA"). If you do not agree to the terms of this EULA, do not install or use the software. ================================================================================ 1. DEFINITIONS ================================================================================ "Software" refers to the BambooBasic compiler, integrated development environment (IDE), documentation, and all associated files included in the distribution package. "Runtime DLL" refers to the BambooBasic runtime library (BambooRuntime.dll) that provides core functionality for programs compiled with BambooBasic. "Executable" refers to compiled programs created using the BambooBasic compiler. ================================================================================ 2. LICENSE GRANT ================================================================================ Subject to the terms and conditions of this EULA, Michael Denathorn grants you a non-exclusive, non-transferable license to: a) Install and use the Software on any number of computers for the purpose of developing software applications. b) Create, compile, and distribute Executables created with the Software for commercial or non-commercial purposes. c) Distribute the Runtime DLL solely in conjunction with Executables created with the Software, as described in Section 3. ================================================================================ 3. REDISTRIBUTION RIGHTS AND RESTRICTIONS ================================================================================ 3.1 RUNTIME DLL REDISTRIBUTION You MAY redistribute the Runtime DLL (BambooRuntime.dll) ONLY under the following conditions: a) The Runtime DLL is distributed ONLY with Executables created using BambooBasic. b) The Runtime DLL is not sold separately or offered as a standalone product. c) You do not modify, reverse engineer, or create derivative works of the Runtime DLL. d) You include appropriate copyright notices acknowledging BambooBasic in your application's documentation or about screen. 3.2 THIRD-PARTY LANGUAGE AND LIBRARY USE If you use the Runtime DLL with programs written in OTHER programming languages or with third-party libraries (not created with BambooBasic), you MUST: a) Post notification of such use in the BambooBasic section of the SyntaxBoom website (https://www.syntaxboom.net). b) Include a description of your project and how the Runtime DLL is being utilized. c) Provide appropriate attribution to BambooBasic in your project's documentation. Failure to comply with this notification requirement constitutes a material breach of this agreement and will result in immediate termination of your license. 3.3 PROHIBITED REDISTRIBUTION You may NOT: a) Redistribute, sublicense, sell, rent, lease, or loan the Software (compiler, IDE, or any development components) in whole or in part. b) Distribute the Software as part of any software development kit, toolchain, or development package. c) Distribute modified versions of the Software or Runtime DLL. d) Distribute the Runtime DLL as a standalone component or library for use by other developers. e) Remove or alter any copyright, trademark, or other proprietary notices from the Software or Runtime DLL. ================================================================================ 4. INTELLECTUAL PROPERTY RIGHTS ================================================================================ The Software is licensed, not sold. Michael Denathorn retains all right, title, and interest in and to the Software, including all copyrights, patents, trade secrets, trademarks, and other intellectual property rights. Your Executables and programs created with the Software are your property, but the Software itself remains the property of Michael Denathorn. ================================================================================ 5. RESTRICTIONS ================================================================================ You may NOT: a) Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software or Runtime DLL, except to the extent permitted by applicable law. b) Modify, adapt, translate, or create derivative works based on the Software. c) Use the Software to develop applications that compete with BambooBasic or duplicate its functionality. d) Remove, modify, or obscure any copyright, trademark, or other proprietary notices contained in or on the Software. e) Use the Software for any illegal purpose or in violation of any local, state, national, or international law. ================================================================================ 6. NO WARRANTY ================================================================================ THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. Michael Denathorn does not warrant that: a) The Software will meet your requirements or expectations. b) The operation of the Software will be uninterrupted or error-free. c) Defects in the Software will be corrected. d) The Software is compatible with all hardware and software configurations. You assume all risks associated with the use of the Software, including but not limited to risks of program errors, damage to equipment, loss of data, or business interruption. ================================================================================ 7. LIMITATION OF LIABILITY ================================================================================ TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MICHAEL DENATHORN BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF MICHAEL DENATHORN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, Michael Denathorn's liability shall be limited to the greatest extent permitted by law. ================================================================================ 8. THIRD-PARTY COMPONENTS ================================================================================ The Software incorporates or links to certain third-party software components, each subject to its own license terms: - SoLoud Audio Engine (zlib/libpng license) - miniz (MIT license) - wxWidgets (wxWindows Library License) - DirectX 12 (Microsoft Corporation) Use of these third-party components is governed by their respective licenses. SUPPORT AND UPDATES ================================================================================ This license does not entitle you to any support, maintenance, updates, upgrades, or bug fixes. Any such services, if provided, are at the sole discretion of Michael Denathorn. Updates and new versions of the Software may be subject to additional or different license terms. ================================================================================ 10. TERMINATION ================================================================================ This license is effective until terminated. Your rights under this license will terminate automatically without notice if you fail to comply with any term of this EULA. Upon termination: a) You must immediately cease all use of the Software. b) You must destroy all copies of the Software in your possession or control. c) Your right to distribute Executables created prior to termination shall survive, but you may not create new Executables. d) Sections 4, 6, 7, and 11 shall survive termination. ================================================================================ 11. GENERAL TERMS ================================================================================ 11.1 ENTIRE AGREEMENT This EULA constitutes the entire agreement between you and Michael Denathorn regarding the Software and supersedes all prior agreements and understandings. 11.2 SEVERABILITY If any provision of this EULA is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect. 11.3 WAIVER The failure of Michael Denathorn to enforce any right or provision of this EULA shall not constitute a waiver of such right or provision. 11.4 GOVERNING LAW This EULA shall be governed by and construed in accordance with the laws of the jurisdiction in which Michael Denathorn resides, without regard to its conflict of law provisions. 11.5 AMENDMENTS Michael Denathorn reserves the right to modify this EULA at any time. Continued use of the Software after such modifications constitutes acceptance of the modified terms. ================================================================================ 12.
